Latin King Members Arrested for March Shooting

On March 6, 2012, at approximately 4:55 p.m., the City of Poughkeepsie 911 Center received a call reporting a shooting on the 15th floor of the Rip Van Winkle Apartments, located at 10 Rinaldi Blvd., in the City of Poughkeepsie. Responding officers located two victims, a 21 year old male and a 21 year old female, in apartment 15M. Each appeared to have been shot one time, and the male was also slashed with a knife. Mobile Life Support Services transported the victims to Saint Francis Hospital Emergency Room for treatment, and both were admitted. The male victim was suffering from a gunshot wound to the face and a laceration to his upper chest area. The female victim was suffering from a gunshot wound to her upper chest. The male victim was later transported to Westchester County Medical Center in critical condition. Both victims have been released from the hospital and have recovered from their injuries. Shortly after the incident, City of Poughkeepsie Detectives arrested six individuals in connection with the shooting who were charged with various crimes from Attempted Murder to Criminal Facilitation.

As a result of a grand jury investigation into the shooting initiated by the Dutchess County District Attorney’s Office, detectives learned that it involved members of the Latin Kings street gang. The grand jury investigation culminated in the indictments of three additional persons for the shooting at the Rip Van Winkle Apartments on March 6, 2012. These individuals were identified as John A. Rizzo, Jr., a 42 year old Hyde Park resident and Timothy Ramirez, a 21 year old resident of East Orange, New Jersey. Both were indicted for multiple crimes including Conspiracy in the Second Degree (a class B Felony), two counts of attempted murder in the Second Degree (class B armed violent Felonies), and two counts of Assault in the First Degree (a class B armed violent felony). Paul Sellers, an 18 year old City of Poughkeepsie resident, was indicted on two counts of Attempted Murder in the Second Degree (class B armed violent felony), Conspiracy (Class B felony), two counts of Assault in the First Degree (class B armed violent felony), two counts of Gang Assault (Class B armed violent felony), and Criminal Possession of a Weapon in the Second Degree (Class C armed violent felony).

On May 29, 2012, the United States Marshall’s Service arrested Timothy Ramirez in the Dallas, Texas area. Ramirez is being held in the Dallas County Jail pending the results of an extradition proceeding to return him to New York State. On May 30, 2012, members of the City of Poughkeepsie Police Detective Division, assisted by the Dutchess County Sheriff’s Office Emergency Services Unit and the Hyde Park Police Department, executed a search warrant at a residence on Crum Elbow Road in the Town of Hyde Park. Taken into custody on that indictment at that location was John A. Rizzo. Later in the day, May 30, 2012, City of Poughkeepsie detectives executed a second search warrant in an apartment building in the City of East Orange, New Jersey, with the assistance of the East Orange (NJ) Police Department. At this time, all of the suspects in the March 6, 2012 shooting incident are in custody. Also arrested in the City of Poughkeepsie on May 30, 2012 was Paul Sellers. Sellers and Rizzo have been arraigned in City of Poughkeepsie City Court. Rizzo was remanded without bail and Sellers was remanded in lieu of $100,000 cash and $150,000 bond. The investigation into this group is on-going.

The City of Poughkeepsie Police Department and the Dutchess County District Attorney’s Office were both assisted by the following agencies during this investigation: The Dutchess County Sheriff’s Office, the Town of Poughkeepsie Police Department, the Hyde Park Police Department, the Hudson Valley Safe Streets Gang Task Force, the United States Marshalls Service, the East Orange (NJ) Police Department, and the Essex County (NJ) Prosecutor’s Office. Without the professionalism and cooperation of the above agencies, the outcome of this investigation would not have come to a successful resolution so quickly.
