Roll Over Leads to DWI Arrest

On Saturday, January 21, 2012, at approximately 1:02 PM, Sgt. Anne T. Therriault was patrolling the area of Bush Hill Road when she observed a vehicle down an embankment.

The vehicle was a green 1995 Pontiac Grand AM operated by Jeffrey Daigle, age 35, of Pelham, New Hampshire. Preliminary investigation showed that Daigle was traveling eastbound on Bush Hill Road when he lost control of his vehicle causing it to go off the roadway and down a twelve foot embankment. The vehicle was heavily damaged and partially submerged in running water. Daigle was found to be unconscious upon initial contact. Within minutes, Daigle regained consciousness and was able to speak to the officer. The Pelham Fire Department arrived shortly after and Daigle was extracted out of the vehicle.

The icy road conditions and alcohol appear to be the cause of the collision. Daigle was subsequently arrested on scene for Driving While Intoxicated. He has two prior convictions for Driving While Intoxicated in the State of New Hampshire. The first offense was out of the Nashua District Court in 1996 and the second conviction was in 2003 out of the Salem District Court, Salem, New Hampshire.

Daigle was transported to the Southern New Hampshire Regional Medical Center where he was treated and released with minor injuries. He was charged with a first offense Driving While Intoxicated and a second offense of Driving While Intoxicated. Daigle is currently being held at the Pelham Police Department.

Bush Hill Road was shut down for approximately one hour due to the crash. This is the second storm related crash within a week that has caused Bush Hill Road to be shut down for an extended period of time.

Diesel fuel has reportedly been stolen from commercial vehicles, storage tanks in the rear of pick-up trucks as well as from heavy duty equipment. Six month drug investigation results in three arrests

On Wednesday December 21, 2011, at approximately 1020 hours, The Pelham Police Department executed a search warrant at 22 Brookview Drive in Pelham as a result of a six month drug investigation.

The investigation revealed that an individual was selling large quantities of marijuana from the residence in what was determined to be a significant drug operation.

Police searched the residence and discovered approximately 12 pounds of Marijuana, packaging equipment, scales, prescription pills, cash and sixteen firearms. The marijuana was discovered behind a false wall in an upper bedroom constructed to hide the drugs.

Three individuals were arrested and charged with the following:

Stephen Lagasse, 24, charged with Possession of a Controlled/Narcotic Drug, Unlawful dealing in Prescription Drugs and Possession with intent to distribute drugs.

Jeffrey Barnaby, 50, charged with Possession of Controlled/Narcotic Drug.

Krystle Barnaby, 24, charged with Possession of a Controlled/Narcotic Drug.

The investigation is ongoing and additional arrests are expected.

Krystle and Jeffrey Barnaby were released with a court date in January.

Lagasse is being held and will be arraigned at the Salem District Court tomorrow morning.

Mammoth Road Convenience Held up at Gun Point

PELHAM CONVENIENCE STORE HELD UP AT GUN POINT

At approximately 6:43 pm the Pelham Police Department received a report of an armed robbery at Mammoth Convenience Store located at Mammoth Road and Bowley Drive.

Upon arrival at the store officers learned from the female employee and two patrons that a lone male had come into the store brandishing a handgun and demanding money from the cash register. The employee obeyed the robber’s demands and surrendered an undetermined amount of cash from the register. Once the robber had obtained the cash he left the store and fled the area in a vehicle which was parked on Bowley Drive.

Investigating officers were able to view the store surveillance cameras and were able to obtain the following information;

White male, thin build, dark colored hair, 5’10 – 6’0” in height, wearing a dark colored baseball cap, jeans, dark colored long sleeve pull over shirt, and a bandanna around his neck which was used to cover his face during the robbery.

Vehicle is described as a small dark colored four door sedan.

Residents of the area are asked to call if they observed the vehicle parked on the wrong side of Bowley Drive at the entrance of Mammoth Convenience Store at the time of the robbery.

Anyone with information concerning this robbery is asked to call the Pelham Police Department.

Two Arrested on Heroin Charges

On Thursday evening at approximately 5:30 pm, the Pelham Police Department received a call of a possible burglary in progress. The caller observed a male climbing through a back window of a residence located on Leonard Drive, in Pelham, NH.

Once on scene, police identified the male in the home as Shane Bell, age 36, of Pelham. He stated that he was just gathering some of his belongings that were in the home. The homeowners were contacted and advised police that the suspect was known to them and previously stayed with them, but was told that he could not return to the residence and should not be in the home at this time.

Upon further investigation, police located a female later identified as Kristen Plante, age 34 of Haverhill, MA, hiding from police under a blanket in the rear portion of Bell’s SUV. As police continued to investigate they located several used needles, prescription pills and heroin within the vehicle and in the room in which Bell had stayed.

The two were placed under arrest and transported to the Pelham Police Station. Shane Bell was charged with Trespassing, Possession of Heroin and Unlawful Dealing in Prescription Medication. Kristen Plante was charged with Possession of Heroin. Both are currently being held at the Pelham Police Station. The vehicle used in this incident has been seized by police and will be held for civil forfeiture proceedings.

NGRID is still on track for bringing all online by this evening.

National Drug Take Back Day

National Prescription Drug Take Back Day

DEA has scheduled another National Prescription Drug Take Back Day on Saturday, October 29, 2011, from 10:00 am - 2:00 pm at the Pelham Police Department to provide a venue for persons who want to dispose of unwanted and unused prescription drugs.

National Prescription Drug Take Back Day addresses a vital public safety and public health issue. More than seven million Americans currently abuse prescription drugs, according to the 2009 Substance Abuse and Mental Health Services Administration’s National Survey on Drug Use and Health. Each day, approximately, 2,500 teens use prescription drugs to get high for the first time according to the Partnership for a Drug Free America. Studies show that a majority of abused prescription drugs are obtained from family and friends, including the home medicine cabinet.

DEA in conjunction with state and local law enforcement agencies throughout the United States conducted National Prescription Drug Take Back Days on Saturday, September 25, 2010 and April 25, 2011. Nearly, 4,000 state and local law enforcement agencies throughout the nation participated in these events, collecting more than 309 tons of pills.

Four days after last fall’s Take-Back Day, Congress passed legislation amending the Controlled Substances Act to allow the DEA to develop a process for people to safely dispose of their prescription drugs. DEA immediately began developing this process after President Obama signed the Safe and Secure Drug Disposal Act of 2010 on October 12. Until that process is complete, however, DEA will continue to hold Take Back Days every six months.

Motorcyclist Seriously Hurt in Accident

On October 10, 2011, at approximately 10:56 AM, members of the Pelham Police Department and the Pelham Fire Department responded to the area of Mammoth Road and Hillside Country Store for a report of a motorcycle crash.

Upon arrival officers observed the driver of the motorcycle lying on the hill in front of Hillside Country Store. The motorcyclist was identified as William Cormier, age 62, Londonderry, New Hampshire. Cormier was operating a 1995 Harley Davidson FLSTC color white and turquoise.

Cormier was conscious and able to tell officers that he was traveling southbound on Mammoth Road. He stated that as he was riding southbound a black sedan drove into his lane of travel as he approached the corner where Hillside Country Store is located. Cormier advised that the black sedan forced him off the roadway causing him to crash his motorcycle.

Cormier suffered non-life threatening serious bodily injury. The Pelham Fire Department provided immediate care until DHart arrived and was able to fly Cormier to Boston for further medical attention.

There were no witnesses to the crash. Anyone with information regarding the black sedan is encouraged to contact Sgt. Anne T. Therriault at (603) 635-2411.

VETERANS OF FOREIGN WARS ANNUAL FUND DRIVE INFORMATION

The police department has been notified that the "Veterans of Foreign Wars, Department of New Hampshire, is conducting its Annual Fund Drive by telephone between 10-1-2011 and 11-15-2011. The Fund Drive raises funds for the 'Boxes from Home' program for all NH troops deployed in Iraq & Afghanistan, financial assistance to the VA Hospitals Assistance Program and assistance to all veterans' local programs benefiting veterans and their families as well as the Homeless Veterans Program...

1. Intent; Authority.

A. The intent of this chapter is to establish a system which fairly and impartially regulates retail transactions of a pawn or secondhand nature for the purpose of identifying stolen property unintentionally received by the regulated parties and detecting regulated parties intentionally transacting business in stolen property.

B. This chapter has been enacted pursuant to the authority granted to the Town of Pelham by New Hampshire RSA 322 and RSA 398.

2. Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

PAWNBROKER -- Any person, firm, partnership, or corporation whose physical business includes any transactions wherein there is the lending of money secured by taking possession of jewelry, wearing apparel, household goods or other personal property, with interest charged thereon, with the right to sell the personal property if it is not redeemed. A person, firm, partnership, or corporation shall be deemed to be a pawnbroker whether the transaction takes the form of a loan by the pawnbroker secured by the property or a sale to the pawnbroker with the right to repurchase within a specified period of time. Pawnbrokers are regulated according to New Hampshire RSA Chapter 398.

SECONDHAND DEALER -- Any person, firm, partnership, or corporation whose business is the retail buying, selling, buy-back, exchanging, dealing in, or dealing with secondhand articles, including but not limited to jewelry, watches, clocks, diamonds or other precious stones or gems, gold, silver, platinum or other precious metals, musical instruments and equipment, cameras, furs, fur coats or other kinds of wearing apparel, collectibles and antiques (excepting furniture and books), home and auto stereo equipment, televisions, video cassette recorders and other electronic equipment, tools computers and computer equipment, auto accessories, and office and store fixtures and related equipment.

Secondhand dealers are regulated according to New Hampshire RSA Chapter 322.

3. Exclusions.

Online or Mail order transactions and retail stores that exchange or provide cash or credit for returned articles are excluded from this chapter. Consignment shops, temporary Flea markets and yard sales are also excluded.

4. Licensing requirements and procedures.

A. No person, firm, partnership, or corporation shall operate, conduct, or engage in business as a secondhand dealer or pawnbroker unless such person, firm, partnership, or corporation obtains a license from the Town of Pelham through the Board of Selectmen in accordance with New Hampshire RSA 322:1 and 398:5.

B. Applications for licenses for a secondhand dealer or pawnbroker shall be made, in writing, to the Town of Pelham on forms provided by the Town of Pelham. An application fee of $100 shall be submitted with the application.

C. (1) The Chief of Police shall cause an investigation to be made of the fitness of the applicant to engage in said business as a secondhand dealer or pawnbroker. This investigation shall be completed within 14 days. Upon conclusion of this investigation, the Chief of Police shall report his findings and forward a recommendation on the application to the Board of Selectmen, through the Town Administrator, for disposition of the license.

(2) No such license shall be issued to any person, firm, partnership or corporation who or which has been convicted of receiving stolen property or who or which has repeatedly violated ordinances or statutes of the State of New Hampshire or any other state or territory related to a business license in the State of New Hampshire or any other state or territory. Approval or denial of a license application will be by a majority vote by the Board of Selectmen after a review of all application materials.

D. Upon approval, a numbered license shall be issued and continue in force until April 1 of each year, unless revoked prior to this date.

(1) It shall be the duty of the licensee to display the current license in a conspicuous place within the business where it may be readily observed by the public.

(2) The license shall be issued for a specific location and is not transferable to any other person, firm, partnership, or corporation.

(3) Once per year, on or before May 1, all persons, firms, partnerships, or corporations that operate, conduct, or engage in business as a secondhand dealer or pawnbroker will be responsible for renewing their license information with the Town of Pelham. This renewal will be completed, in writing, on forms provided by the Town of Pelham. A renewal fee of $100 shall be submitted yearly with the renewal application. Failure to comply with this requirement may result in suspension or revocation of said license.

5. List of employees; conformance with rules and regulations

A. In accordance with section 4B, all secondhand dealers and pawnbrokers must submit a list of personnel that will be employed by the business. In addition to this requirement, it shall be the responsibility of the business owner to notify the Pelham Police Department whenever a new employee is hired by the business. In the case of a new employee, the same information will be requested as per the original application for license.

B. Each applicant shall agree to conform to all rules and regulations governing such businesses now in effect or as subsequently enacted.

6. Prohibited transactions

A. No pawnbroker, nor any person employed by a pawnbroker, shall directly or indirectly receive in pawn or as security for any loan, transfer, service, undertaking or advantage any aforementioned article from any minor in accordance with New Hampshire RSA 398:2.

B. No secondhand dealer or pawnbroker, nor any person employed by a secondhand dealer or pawnbroker, shall directly or indirectly purchase any aforementioned article from any person under the age of 16 years old, knowing or having reason to believe him or her to be such, except when said minor is accompanied by a parent or legal guardian, who shall sign the transaction record in person before said dealer in accordance with New Hampshire RSA 322:3.

C. No secondhand dealer or pawnbroker, nor any person employed by a secondhand dealer or pawnbroker, shall receive in pawn, or as security for any loan, transfer, service, undertaking, or advantage, any property of value from any person in a visible state of intoxication from liquors, drugs, or otherwise or any article of clothing removed from the person at the place of business in accordance with New Hampshire RSA 398:2.

7. Records

A. Every secondhand dealer or pawnbroker, upon the acquisition of any aforementioned article, shall prepare transaction records (written in the English language) upon forms provided by the Town of Pelham. This form shall state the full name, identification number, date of birth, address and other descriptive information of the seller, date of the transaction, a full, accurate, and detailed description (to include make, model, and serial number) of each article, and the monetary amount given for the article.

B. Positive identification in the form of a photographic identification shall be required for all transactions and the type if identification used shall be noted on the dealer’s records. This record shall be legibly signed by the seller in person. At not time will the pawnbroker or secondhand dealer accept another person’s photographic identification for any acquisition. The secondhand dealer or pawnbroker shall attach a photocopy of the identification shown to the transaction record. A photocopy of the article, if required by the nature or the size of the item, will also be attached to this form. Jewelry, watches, diamonds or other precious stones or gems, gold, silver, platinum or other precious metals or items by virtue of their size shall be photocopied by use of a document photocopier. All pawn or secondhand deal stores shall be equipped with electronic monitoring/recording equipment that records all public entrances to the building and all transactions being conducted. The equipment shall consist of video or digital imaging of a sufficient resolution and clarity to be easily monitored and reviewed on playback. All stores must keep an archive of video for 30 days

C. One copy of all transaction records shall be delivered to the Pelham Police Department within 24 hours of the end of said dealer's business day in which the transaction took place.

D. In the case of a pawnbroker, a ticket or coupon shall be given to the pledgor in all cases where any aforementioned article is received in pawn or otherwise for the security of any loan, transfer, service, undertaking, or advantage given to the pledgor. This ticket or coupon shall state the name and address of said pawnbroker, a description of the property or article received in pawn, the monetary value loaned, and the rate of interest established. At the time of making the loan, an identification number shall be attached to the article, and this identification number shall be recorded on the ticket or coupon.

E. Every secondhand dealer and pawnbroker shall retain the original copies of acquisition records in his possession, which, together with any article which is kept or stored in or upon such premises, may be inspected at any time by a duly authorized police officer during regular business hours. All reasonable efforts will be made to avoid disrupting the normal course of business.

F. All original transaction records shall be kept by said secondhand dealer or pawnbroker for a minimum of five years for purposes of this chapter. State and federal regulations may require longer retention (i.e., Department of Labor, Internal Revenue Service, etc.)

8. Resale, disposal and alteration of articles

No article purchased shall be sold, encumbered by sales contract, or otherwise disposed of or altered in its appearance, within twenty-one days of purchase, except with the written permission of the Chief of Police, or designee, but in no case within 24 hours after the time of purchase. Pawnbrokers shall retain pledged nonperishable articles for at least four months after date of deposit and perishable articles for one month after date of deposit.

9. Removal of articles by police officers.

A. If the Pelham Police Department determines that an article is needed for evidence in a criminal investigation, an authorized agent of the Department shall seize that evidence pursuant to applicable criminal procedures. The secondhand dealer or pawnbroker shall be issued a receipt for the article.

B. Pursuant to New Hampshire RSA 595-A:6, the Pelham Police Department, or an authorized agent of the Pelham Police Department, shall keep seized articles under the court's direction as long as necessary to permit the article to be used as evidence. At the conclusion of all court proceedings or closure of the police investigation, the Pelham Police Department shall notify, by regular mail at the last known address, the original owner, the secondhand dealer or pawnbroker, and any other known person who may have a lawful interest that the property will be released in 30 calendar days to the original owner, if no other claim is placed on the property.

10. Violations and penalties

A. Any violation of this chapter shall be punishable by a fine of not less than $25 or more than $100 for each offense and/or subject to criminal prosecution under existing New Hampshire laws.

B. The Board of Selectmen may, independently or upon recommendation from the Chief of Police, suspend or revoke said license for any violation of this chapter or reasons it deems to be in the best interest of the community, after a hearing. Offenses which may result in the suspension or revocation of said license include but are not limited to the following:

(1) Violation of any provision of this chapter; or

(2) Violation of any statute of the State of New Hampshire or any other state or territory of the United States relating to the licensed business.

C. Time limits of the suspension or revocation shall be left to the discretion of the Board of Selectmen. Notice of the suspension or revocation will be made, in writing, to the owner(s) of the business.

Fish and Game: Be Out of the Woods and Off the Water by Saturday Evening

CONCORD, N.H. – The State of New Hampshire will experience a significant weather event this weekend, which will likely bring high winds – including the possibility of hurricane force winds – and heavy rains, which could cause flash flooding, particularly in small streams and rivers. Due to the severity of this storm, N.H. Fish and Game Department Executive Director Glenn Normandeau is urging all outdoor enthusiasts to be out of the woods, off the water and headed for home by Saturday evening.

"It is unlikely that search and rescue operations will be feasible during the height of the storm. For that reason, we are urging the public – whether you're hiking, camping, fishing or boating anywhere in the state – to complete your outdoor recreation and get home by Saturday night. For your safety and the safety of rescue personnel, get out of the woods and off the water by Saturday evening,” Normandeau said.

Campgrounds and day use areas in all New Hampshire State Parks, Forests and Trails, will be closed from 6 p.m. on Saturday, August 27, through Monday, August 29. Parks plan to reopen on Tuesday morning. The reopening of the parks will be subject to any damage and debris removal needed in the aftermath of the storm.

The National Forest Services has also informed the State that all trails and campgrounds in the White Mountain National Forest will be closed. Appalachian Mountain Club huts will also be closed. Trailheads will be posted and parking lots gated. Those in the hiking community are urged to spread the word to fellow hikers and backcountry campers.

Anticipated heavy rains can cause flash flooding that can turn tiny mountain brooks into raging, impassable torrents without notice. Statewide, all waterbodies are expected to rise, and flows to become too swift and strong to navigate safely. Boaters are advised to stay off waterbodies statewide on Sunday and stay off until conditions improve.

DHHS Reminds Residents of Health Precautions to Take During and After a Hurricane

Concord, NH – Hurricane Irene is heading up the Eastern seaboard and there is a good possibility it will impact New Hampshire with strong winds, heavy rain, and power outages. The New Hampshire Department of Health and Human Services (DHHS) Division of Public Health Services is urging residents to prepare and to take precautions against certain public health risks such as carbon monoxide poisoning, contaminated water, and spoiled food.

“While it is a little difficult at this point to know exactly how bad the storm will be,” said Dr. José Montero, Director of Public Health at DHHS, “people should prepare now just in case. Part of preparing should include knowing how to avoid potential hazards related to downed power lines, lack of electricity, and contaminated water.”

Carbon monoxide is an odorless and colorless gas emitted when fuels are burned, such as wood, propane, and natural gas. The more common symptoms can include dizziness, headache, blurred vision, weakness, vomiting, chest pain, nausea, and confusion. Extended exposure can result in death. If there is a power outage, do not bring outdoor cooking or heating units indoors, such as grills or portable fireplaces.

For an extended power outage, food safety is an issue. DHHS recommends taking the following steps during and after a weather emergency:

Never taste food to determine if it is safe
Keep the refrigerator and freezer doors closed as much as possible to maintain the cold temperature
The refrigerator will keep food safely cold for about 4 hours if it is unopened. A full freezer will hold the temperature approximately 48 hours (24 hours if it is half full) and the door remains closed
Food can be safely refrozen if it still contains ice crystals or is at 40°F or below
Get block ice or dry ice to keep your refrigerator and freezer as cold as possible if the power is going to be out for an extended period of time
Discard refrigerated perishable food such as meat, poultry, fish, soft cheeses, milk, eggs, leftovers, and deli items after 4 hours without power.

Storm water can carry sewage, chemicals, germs, and fuel. DHHS reminds people to take care and keep the following in mind in dealing with flooding:

Avoid floodwater and flooded areas. Wear protection if you must travel through water that is part of a flood.
If you use well water and your well has been flooded, make sure the well is tested and disinfected before using water to wash dishes, brush your teeth, wash and prepare food, wash your hands, make ice, or make baby formula
Disinfect any items that come in contact with floodwater. Use ¼ cup of bleach per gallon of water as a disinfectant
Remember that moisture accelerates mold growth, which can cause disease and allergic reactions. Remove standing water and wet items from indoors as soon as possible

Homeowners Urged To Use Caution When Clearing Storm-Damaged Trees

(Concord, NH) Once again Mother Nature will be sending New Hampshire some challenging weather – this time in the form of a hurricane. It is expected that the strong winds and heavy rains associated with Hurricane Irene will cause trees to fall; blocking roads and damaging buildings and power lines. In the days following the storm residents may be anxious to clear fallen trees and limbs from around their property. However; the New Hampshire Division of Forests and Lands and UNH Cooperative Extension urge homeowners to use the following appropriate precautions when clearing storm-damaged trees.

The best advice is a word of caution: Removing large trees or limbs is dangerous. Don’t climb a ladder with a chain saw. Don’t climb into a damaged tree. Never touch any tree near electrical wires. Assess your particular tree situation carefully and watch for safety hazards. Most tree work needs to be done by professional arborists, especially when the work requires climbing or the tree is leaning against another tree or structure. If you’re going to work on your trees yourself, make sure you have the skills and the right safety gear.

Hire an arborist: Trained arborists are aware of proper pruning and removal procedures and can reduce the chance of further damage to the tree. Check to see that they are certified and ask for certificates of insurance, including proof of liability for personal and property damage and worker’s compensation. Also, request local references and get more than one estimate.

Hire a forester: If you own large acreage, contact your County Extension Forester or a licensed forester to assess the damage, and then salvage the trees if needed. Over time, damaged trees may develop decay and discoloration. As long as it is safe, there is no need to rush. You have more than a year to act before you lose wood to discoloration and decay.

Brad Simpkins, Interim Director of the NH Division of Forests and Lands reminds homeowners to be safe, “The trees and forests will recover. It is important people take care of themselves, first”.

The male is described as wearing black and possibly carrying a rifle. The male was seen walking and made no overt threats to witnesses. PPD suspects male is a hunter however several patrol units are on scene and a k-9 unit is in route. These delays and detours will be taking place to assist with the Wake and Funeral for Lowell, MA Police Officer Charles Panek who died on Saturday, July 23, 2011 in a drowning accident on the Merrimack River in Tyngsboro, MA. Officer Panek previously resided in Pelham and was a 1999 Pelham High School graduate.

PELHAM POLICE EXPLORER POST 635

The Police Explorer Program is a program open to all youth from the community ranging from 14 to 21 years in age. The Police Exploring Program is sanctioned by the Boy Scouts of America, and is maintained and staffed by members of the Pelham Police Department. It is strictly a volunteer program that gives service to the Police Department and the community. The Exploring Program is a structured program that gives young men and women the academic and technical training needed to become future Law Enforcement Officers. The program also gives Explorers the leadership skills and self-discipline needed to become successful community leaders.

To become a Police Explorer, applicants must attend an Explorer Academy, which teaches the basic skills utilized by Explorers throughout their Explorer experience. The Explorer Program focuses on team building skills and unity, while teaching these young men and women to work together for one common goal.

The Explorer Academy is a discipline Academy that focuses on physical conditioning, reading, writing and comprehension skills, as well as interpersonal communications. The Explorer training also includes technical training utilized by everyday Police Officers. Explorer Advisors and Explorer Drill Instructors staff the Explorer Academy.

Once an Explorer Cadet completes the Explorer Academy, they become Pelham Police Explorers. Police Explorers provide a valuable service to the community by assisting in traffic related duties, fingerprinting of children for "Kid print" programs, Color Guard details for community functions and Administrative service to the Police Department. Explorers also compete in and attend regional and local Explorer Competitions and Fun Days. These competitions challenge Explorers in team activities and also in individual physical competition events.

To become a Police Explorer, one must complete an Explorer Application and return the application to the Police Department. Police Explorer Cadets will be introduced into the Explorer Program and attend monthly meetings, while being assigned to a Senior Explorer to assist them throughout their Academy training.

MAN BEING HELD FOR ASSUALT WITH KNIFE

On May 29, 2011 at approximately 12:25 am the Pelham Police Department responded to a Greely Road residence for the report of a domestic dispute. While officers were responding to the home the female caller reported that her brother-in-law had armed himself with a knife and that he had cut his mother-in-law with the knife.

Upon arrival at the residence officers learned that the male individual, later identified as MIGUEL RIVERA, 32 years of age, Pelham, NH, was locked in a room with his father-in-law. Officers attempted to have someone unlock the door but were unable to receive compliance from the two men, officers were then forced to gain entry into the room by kicking in the door. Once inside the room officers found Rivera to be uncooperative with the officer’s commands. After a short period of time Rivera began to comply with the officers and he was taken into custody.

During the domestic dispute the mother-in-law was allegedly cut with the knife across the right cheek and was physically pushed by Rivera. The victim received non-life threatening injuries and refused medical treatment at that time.

Rivera was transported to the police station where he was charged with Second Degree Assault

(Felony), Simple Assault (Misdemeanor), and Criminal Mischief (Misdemeanor) and was held for arraignment on May 31^st before the Salem, NH District Court. At his arraignment bail was set at $5000.00 cash bail and Rivera is currently being held at the Hillsborough County House of Correction, Manchester, NH awaiting a probable cause hearing.
